Terms of Service

1. Acceptance of Terms

By accessing or using ClinicalAssist ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

ClinicalAssist is an AI-powered clinical decision support tool designed for UK healthcare professionals. It provides differential diagnosis suggestions, investigation recommendations, prescribing information, clinical calculators, and care pathway guidance. The Service is a decision support tool only and is not a medical device. See our Medical Disclaimer for full details.

3. Eligibility

The Service is intended for use by qualified healthcare professionals, healthcare students under supervision, and other clinical staff. By registering, you confirm that you are a healthcare professional, student, or otherwise authorised to access clinical decision support tools. You must be at least 18 years of age to create an account.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not share your account with others or allow unauthorised access. Notify us immediately at hello@clinicalassist.io if you suspect unauthorised use.

5. Clinical Responsibility

All clinical decisions remain your sole professional responsibility. ClinicalAssist provides suggestions and information to support your clinical reasoning, but does not replace your professional judgement, training, or duty of care. You must independently verify all recommendations against current clinical guidelines, your country's official medicines source or formulary, local protocols, and the individual patient's circumstances.

6. Patient Data

You must not enter patient-identifiable information into ClinicalAssist unless you have ensured compliance with your organisation's information governance policies, UK GDPR, and the Caldicott Principles. Assessment data is stored locally on your device only. We recommend using anonymised or pseudonymised data wherever possible.

7. Subscriptions and Payment

ClinicalAssist offers free and paid subscription tiers. Paid subscriptions are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice. Refunds are available within 14 days of initial purchase if you are dissatisfied with the Service.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Use automated tools to scrape or bulk-access the Service
• Share AI-generated clinical output publicly without appropriate context and disclaimers
• Misrepresent ClinicalAssist output as your own independent clinical analysis in publications or legal proceedings

9. Intellectual Property

All content, design, code, and AI models within ClinicalAssist are owned by or licensed to us. Clinical calculator algorithms are implementations of published scoring tools and are provided for educational and clinical use. You may not reproduce, distribute, or create derivative works from the Service without written permission.

10. Limitation of Liability

To the fullest extent permitted by English law, ClinicalAssist and its developers shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service, including but not limited to clinical outcomes, patient harm, or loss of data. The Service is provided "as is" without warranties of any kind, express or implied.

11. Indemnification

You agree to indemnify and hold harmless ClinicalAssist, its developers, and associated parties from any claims, damages, or expenses arising from your use of the Service, including any clinical decisions made using ClinicalAssist output.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email with at least 14 days' notice. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
